PRIVACY POLICY


Campbell, Marr LLP has always taken care to guard personal information with utmost care and diligence. Effective January 1, 2004 , the federal Personal Information Protection and Electronic Documents Act will impose additional administrative requirements on our firm's collection, use and disclosure of personal information. As a firm, we are committed to complying with the new legislation, and have accordingly enacted this Personal Information Policy to serve as our mission statement with respect to the management of personal information.

We wish to assure clients that Campbell, Marr LLP does not, as a matter of course, provide client information to third parties, unless doing so is necessary to provide our client with that client's requested legal services. Furthermore, the new legislation does not permit just anyone to request access to personal information - only you have the right to request access to personal information about yourself. Some of this information may also be subject to solicitor and client privilege.



What is personal information?

Personal information is any information about an identifiable individual, but does not include an employee's name, title or business address or telephone number (in other words, "business card" type information). Types of personal information include a person's name, address and telephone number; age, gender, family and marital status; medical and health information; occupation, income, credit rating; identification numbers including Social Insurance Numbers; employment information; assets, liabilities, payment records. This list is not exhaustive.

 

Why does Campbell, Marr LLP collect, use or disclose personal information?

Campbell, Marr LLP only collects, uses and discloses information where such collection, use and disclosure is necessary for the purpose of running our law firm. Our primary goal is to provide legal services to our clients, and we may collect information from or about our clients, employees, contract staff, and others, for that purpose.

We may collect personal information about clients, if we need that information in order to give them adequate legal advice or services. The kind of information we collect will depend on the nature of our client's case. For instance, we may collect medical information from a client seeking advice on a personal injury claim, but we would not generally collect medical information from a client who simply requires a lawyer to purchase a house. Another purpose of collecting personal information about clients, such as telephone numbers and home addresses, may be to communicate with the client if contacting them at work is inappropriate.

We may collect personal information about our employees and contract staff, for the purposes of paying their salaries and contract expenses, for providing them with income tax paperwork, and for contacting them at home if necessary in an emergency.

We may also collect personal information about third parties, if necessary in the course of providing legal services to our clients.

 

Fair Information Principles

Campbell, Marr LLP is committed to protecting personal information in accordance with the ten guiding principles set out in Schedule 1 of the federal Personal Information Protection and Electronic Documents Act (the "Principles"). These are:

 

1. Accountability

Campbell, Marr LLP is responsible for personal information under our control, and has designated an individual to oversee Campbell, Marr LLP's compliance with the Principles. Although Campbell, Marr LLP has appointed a Personal Information Officer, Campbell, Marr LLP recognizes that the firm as a whole is accountable for its compliance with the Principles. Campbell, Marr LLP's Personal Information Officer is Ian Clunie.

Campbell, Marr LLP will use contractual or other means to provide a comparable level of protection of personal information if and when it is being processed by a third party.

Campbell, Marr LLP has introduced policies and practices to give effect to the Principles.

 

2. Identifying purposes

Campbell, Marr LLP shall identify the purposes for which personal information is collected, at or before the time the information is collected. Depending on the way in which information is collected, this may be done either orally or in writing.

Generally, Campbell, Marr LLP only collects information where that collection is necessary for the purpose of running our law firm. Our primary goal is to provide legal services to our clients, and we may collect information from or about our clients, employees, contract staff, and others, directly or indirectly for that purpose.

 

3. Consent

Campbell, Marr LLP will not collect, use or disclose personal information about a person without that person's knowledge and consent, unless it would be inappropriate to obtain his or her consent and we are permitted by law to dispense with consent.

Consent might be implied from the circumstances. For instance, when we collect information from you as a client, under normal circumstances, solely for the purpose of providing services, consent may be implied. However, in some cases, Campbell, Marr LLP may ask you for your express consent, particularly where the personal information is especially sensitive (for instance, medical or income information).

 

4. Limiting collection

The collection of personal information shall be limited to that which is necessary for the purpose of running our law firm. Information shall be collected by fair and lawful means.

 

5. Limiting use, disclosure, and retention

Campbell, Marr LLP shall only use or disclose personal information for the purposes for which we collected it, except with the person's consent or where permitted by law to use or disclose it for another purpose. Personal information shall be retained only as long as necessary for the fulfillment of those purposes, and as long as is required by laws such as The Law Society Act ( Manitoba ) and the Income Tax Act ( Canada ).

 

6. Accuracy

Campbell, Marr LLP will strive to ensure that personal information be as accurate, complete and up-to-date as is necessary for the purposes for which it is to be used, and to minimize the possibility that inappropriate information may be used to make a decision about an individual.

 

7. Safeguards

Campbell, Marr LLP shall protect personal information by security safeguards appropriate to the sensitivity of that information.

 

8. Openness

Campbell, Marr LLP shall make readily available to individuals specific information about its policies and practices relating to the management of personal information. 9. Individual access

Any person may make a formal, written request for information on the existence, use and disclosure of his or her personal information and, where appropriate, shall be given access to that information. That person shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate.

 

10. Challenging compliance

Campbell, Marr LLP's Personal Information Officer will answer any questions any person may have concerning Campbell, Marr LLP's compliance with the above Principles.
